Introduction: What are cookies and what do we use them for?

A cookie is a text file stored on the user’s computer or mobile device (smartphone or tablet) by the user’s web browser the first time they visit a website, that is recognized by the server that installed it whenever they visit that website again. All cookies contain information (i.e. the server they come from, a numeric ID, expiry date, etc.) so that the website that installed them can remember the user’s preferences when browsing, purchasing items, and logging in to private areas of the website, monitoring their sessions.

Cookies can be installed by the owner of the browsed website (first party cookies), as well as by other websites that install them on its behalf (third party cookies) and can recognize them. This is because the website may contain elements – such as images, maps, sounds or links to other domains pages, etc. – that may be hosted on different servers.

Pursuant to the Provision by the Italian authority for the protection of personal data of May 8th, 2014 “Identifying seamless ways to inform users and collect their consents on the use of cookies” (hereinafter, “Provision”), third parties are responsible for informing the users and, if necessary, obtaining their consent on the use of third party cookies. The website owner, as technical intermediary between these third parties and the users, is required to insert the updated links to third party policies and consent forms in its extended policy.

Cookies can be divided in technical cookies and profiling cookies according to their specific purpose.

Technical cookies are installed in order to “transmit messages on an electronic communication network or to the extent strictly necessary to provide a service expressly required by the subscriber or user”. They are generally used to guarantee effective browsing of the website pages, record the user’s preferences or their specific settings, log-in information, etc.
Technical cookies can be classified as browsing cookies, used to record useful data for the proper browsing and functioning of the website on the user’s computer (i.e. a webpage dimension in a list), and functional cookies, used to store the specific settings of each user, such as the country selection and permanent access, where possible. Some of these cookies – called strictly necessary cookies – are essential to perform certain operations on the website.

Technical cookies may also include analytic cookies – that therefore, as stated in the Provision, do not require the user’s consent or other legal requirements to be installed – only if produced and used directly by the website owner (no third party cookies), for the optimization of the website, and to collect aggregated information on the number of users who visit the website. They also include third party cookies used by the first party for analytical purposes, and only after the adoption of de-identification measures such as hiding a significant part of the IP address.

Technical cookies do not require the user’s consent. Technical cookies that are strictly necessary for the proper functioning of the website can be installed on the user’s browser, together with third party analytical cookies regarded as technical cookies and used by the website owner to collect aggregated information on the number of users who visit the website, without prejudice to the obligation to inform them in accordance with Section 13 of European Regulation n. 2016/679 (or GDPR).

Profiling cookies are used to track the user’s browsing, analyse their behaviour for marketing purposes and create profiles on their tastes, habits, choices etc., in order to send them targeted advertising messages related to their interests and consistent with the preferences they expressed while browsing.

As stated in the Provision, these cookies can be installed on the user’s devices only with their written consent. According to their lifespan, cookies can be called persistent cookies, which are stored on the user’s device until a specific date unless expressly deleted by the user, or session cookies, temporarily stored on the user’s device and deleted when they close the browser.

How to consent to the use of profiling cookies


  1. When first visiting, the user can consent to all cookies through one of the following: closing the banner by clicking on the X on the corner; closing the banner by clicking on the “I Accept” button; continuing browsing by accessing another area of the website or selecting an element within it.
